General Terms and Conditions for the Provision of Taivas Signature Services

1. Identification
These Terms govern services contracted directly with:

2. Services
Taivas provides personalised services including: travel advisory; travel consulting; planning; research; itinerary design; concierge; coordination; preparation of personalised guides; booking assistance; and support before, during or after the trip.
The specific scope will be as stated in each proposal or engagement.
3. Third-party services
Unless the specific documentation provides otherwise, Taivas is not the actual provider of accommodation, flights, transport, excursions, activities, dining or any other service performed by third parties.
The corresponding confirmations will identify the supplier, agency, operator or entity involved.
Services provided by third parties will be subject to their own terms and conditions.
Nothing in these Terms seeks to exclude mandatory rules.
4. Fora Travel
Hugo García Gil carries out his activity as a travel advisor affiliated with Fora Travel.
Certain bookings may be made through agreements, credentials, systems or suppliers available through Fora Travel.
Where a booking is processed through Fora, Fora's rules and those of the corresponding supplier must be observed.
5. Payment of Fora bookings
As a general rule, bookings managed through Fora will be paid directly by the client to the corresponding supplier through its secure systems.
Taivas will not use its own card to pay for client bookings managed through Fora where the applicable Fora rules prohibit it.
6. Suppliers outside Fora
Taivas may recommend or coordinate services provided directly by other suppliers.
The applicable contractual conditions will be those of the supplier.
7. Exceptional payments on behalf and for the account of the client
Where: the channel used allows it; there is no contractual prohibition; and the client has given express authorisation, Taivas may exceptionally advance an amount to a supplier on behalf of and for the account of the client.
Where the payment meets the legal and tax requirements to qualify as a reimbursable disbursement: the service belongs to the client; the invoice must be issued in the client's name where required; an express mandate exists; Taivas recovers exactly the amount paid; no margin is added; Taivas's fees are shown separately; Taivas keeps the receipt; and Taivas does not deduct the corresponding VAT as its own.
If the payment does not meet the legal requirements to qualify as a reimbursable disbursement, it must receive the corresponding accounting and tax treatment.
8. Taivas fees
Taivas may charge fees for: travel planning; advisory; research; itinerary design; concierge; coordination; management; or personalised services.
The price will be communicated in advance.
These fees are independent of the price of services provided by third parties.
9. Commissions
Certain bookings may generate supplier commissions.
A supplier may pay a commission to Fora Travel and Fora may subsequently remunerate the advisor in accordance with their contractual relationship.
The existence of a commission does not in itself alter the price confirmed by the supplier to the client.
Where Taivas also charges a fee directly to the client, the client will be informed separately.
10. Booking authorisation
Before making a booking involving: payment; deposit; non-refundable rate; or a relevant penalty, Taivas will request the client's authorisation.
The confirmation must identify: service; supplier; travellers; date; price; currency; payment method; and cancellation conditions.
11. Client data
The client must carefully check: first name; surname; date of birth; passport; documentation; destination; dates; and all other necessary information.
12. Prices and availability
External suppliers' rates and availability may change until the booking is confirmed.
A proposal does not guarantee availability.
13. Cancellations
Third-party services will be subject to the corresponding cancellation, amendment and refund policies of the supplier.
14. Withdrawal from Taivas services
Where a legal right of withdrawal exists, the consumer will have the corresponding statutory period.
If the client asks Taivas to start providing the service before that period ends, they must request it expressly.
If the service is performed in full during that period meeting the legally established requirements, the right of withdrawal may be extinguished.
If withdrawal occurs after performance has begun, the proportional part of the service already performed may be payable where legally applicable.
15. Digital guides and itineraries
Taivas may sell personalised guides and digital itineraries.
Before purchase the following must be stated: content; price; taxes; format; degree of personalisation; estimated timeframe; delivery method; and technical requirements.
Where legally applicable, express consent will be requested to begin preparation or supply before the end of the withdrawal period.
16. Services on a specific date
Certain third-party services relating to: accommodation; transport; dining; activities; or leisure on a specific date or period may be subject to legal exceptions to the right of withdrawal.
17. Package travel and linked travel services
Taivas will not use the formal separation of payments, contracts or suppliers for the purpose of circumventing mandatory rules on package travel or linked travel services.
Where an operation must legally receive such classification, the corresponding rules will apply.
18. Travel documentation
The traveller is responsible for holding: passport; visas; authorisations; certificates; health documentation; and entry or exit requirements.
Taivas may provide indicative information.
The information must be verified with official sources.
19. Insurance
Taivas recommends considering the purchase of appropriate travel insurance.
20. Liability
Taivas is liable for its own services and obligations in accordance with applicable law.
Independent suppliers are liable for those services whose performance falls to them.
Nothing in these Terms limits non-waivable consumer rights.
21. Circumstances beyond control
Taivas does not control circumstances such as: weather; strikes; airline cancellations; administrative decisions; closures; conflicts; operational problems; or third-party actions.
Taivas may assist the client within the scope of the contracted services.
22. Intellectual property of guides and itineraries
Itineraries, documents, guides, designs and original contents prepared by Taivas are for the client's personal use unless otherwise agreed.
They may not be resold or commercially distributed without authorisation.
23. Data protection
Data will be processed in accordance with the Privacy Policy.
24. Communications
Communications may take place by: email; phone; WhatsApp; forms; or any other agreed channel.
Communications relating to bookings and engagements may be retained for the necessary periods.

26. Applicable law
These Terms are governed by Spanish law.
In contracts with consumers, mandatory rules on jurisdiction and consumer protection will be respected.
27. Particular conditions
Conditions expressly agreed for a specific service prevail regarding the matters specifically regulated.
28. Versions
The applicable version is the one accepted at the time of contracting.
Taivas will keep evidence of: accepted version; date; time; service; client; price; and specific consents.
